类型化视角下非遗知识产权保护体系研究

摘要
非遗知识产权保护的类型化梳理是非遗知识产权保护体系构建的前提,类型化思维和传统概念化思维的有效互补可以化解非遗知识产权保护的规则冲突.以促进文化传承和推动区域经济发展为价值标准规划出非遗知识产权保护的具体路径,通过利益平衡原则指导下的非遗"权利主体"和惠益原则指导下的非遗"保护客体"类型化分析,解构非遗的传统类型,厘清非遗知识产权保护的内容和样态,合理重构非遗知识产权保护类型,为非遗知识产权保护提出有效配置方案,实现非遗知识产权保护的良性循环.
Abstract
The typological clarification of the intellectual property rights protection of intangible cultural heritage(ICH)is a prerequisite for constructing the protection system of the ICH intellectual property rights.The effective complementarity of the typological thinking and the traditional conceptual thinking can resolve rule conflicts in the ICH intellectual property rights protection.Planning specific ap-proaches for the ICH intellectual property rights protection is guided by the values of promoting cultural heritage and driving the regional economic development.A typological analysis of the ICH"rights-holders"guided by the principle of balancing interests and the ICH"objects of protection"guided by the principle of benefits helps to deconstruct the traditional ICH types,elucidate the content and mo-dalities of the ICH intellectual property rights protection,rationally reconstruct the ICH types of intellectual property rights protection,propose effective allocation schemes for the ICH intellectual property rights protection,and realize a virtuous cycle in its protection.
