Based on the current situation of diagnosis and treatment standard and legal regulations regulating excessive medical treatment,this paper analyzes problems such as unclear scope of diagnosis and treatment standard and defective legal regulations,so as to better prevent and regulate excessive medical treatment behaviors,improve medical service quality and improve medical treatment en-vironment.It is suggested that the scope of diagnosis and treatment standard regulating excessive medical treatment should be ex-panded,different diagnosis and treatment standard should be formulated according to the emergency degree of the disease,the diagnosis and treatment standard in traditional medicine should be improved,and Article 1227 of the Civil Code should be amended and perfected.
