By analyzing the relevant provisions of the current Mental Health Law on the qualification of the subject and the qualifi-cation of the practitioner of psychotherapy,it is found that it has a certain regulatory role in dealing with the problems in psychotherapy,but it is too principled,abstract and vague,which leads to some problems in the application of the law of psychotherapy.Starting from the protection of the rights and interests of the subjects of psychotherapy and those receiving psychotherapy,this paper analyzes the real-istic legal dilemma of psychotherapy activities in China,discusses the need for legislation and the possibility of legislation,and puts for-ward corresponding countermeasures and suggestions to improve the relevant provisions in the Mental Health Law and the relevant judi-cial interpretation,and formulate the"Psychologist Law"to clarify the qualification standards of psychotherapy in order to fill the gaps in the current law,and better standardize and legalize the implementation of psychotherapy.
