摘要
执行法官的履职安全在实务中常受到来自当事人甚至第三人的暴力行为和软暴力行为的冲击,而现有的法官生命健康权益保障制度却存在组织乏力、保障范围有限、对暴力侵害行为惩处力度不足、缺乏专门保障队伍及相关规定有缺陷等问题;应予侵害执行法官履职中生命健康权益的行为作等级分类,明确该权益保障的责任主体,规范执行法官紧急处置权的行使,建立执行法官个人及其家属的信息全面保护制度,加强对相关侵害行为的处罚力度.
Abstract
In practice,the security of executive judges is often affected by violent acts and soft violent acts from parties or even third parties.However,the existing guarantee system of judges'life and health rights protection has some problems,such as weak orga-nization,limited protection scope,insufficient punishment for violent acts,lack of special guarantee team and defects in relevant regu-lations.It is necessary to classify the acts that infringe upon executive judges'life and health rights protection in judicial execution,clarify the responsibility subject of the rights and interests protection,standardize the exercise of the executive judges'emergency dis-posal power,establish a comprehensive information protection system for the executive judges and their families,and strengthen the punishment for related violations.
