摘要
作品保护制度是在造纸术和印刷术的基础上产生的.在此之后,作品保护制度又经历了留声机技术、电影制作技术和广播技术的挑战,并且做出了相应的调整.自20世纪末期以来,数字技术和网络技术再次带来挑战,主要体现在作品的数字化、技术措施和权利管理信息的保护,以及如何界定网络服务商的侵权责任.目前,我国学术界和司法实务界应当更多地关注网络服务商责任的问题,而非作品的数字化.
Abstract
The technologies of communicating works to the public are closely related to the protection systems of works.On the basis of the technologies of paper making and printing,the systems of works protection have been established worldwide.Since then,a series of technologies of communicating works have emerged,including phonograms,photos,motion pictures,and broadcasting,and challenged the systems of works protection.Since the end of 20th century,the technologies of digitalization and internet again challenged the systems of works protection,including digitalization of works,protection of technological measures and right management information,and the liability of internet service providers.It seems that in order to promote the protection of works,the academic circles and judges in China shall pay more attention to the liability of internet service providers rather than the digitalization of works.
