摘要
随着人工智能技术的突破,特别是大模型技术如Sora的发展,影视创作模式正经历着前所未有的变革.这种变化不仅极大地拓宽了创作的边界,还挑战了传统版权法体系的核心概念,包括作者身份、作品原创性以及作品归属等.Sora大模型促进了人机合作的新形式,使得艺术创作活动更加多样化,同时也引发了关于版权归属、保护期限以及合理使用等法律问题的重新考虑.面对这些挑战,版权法需要适应新兴创作实践,寻找保护个体权益与促进技术发展之间的新平衡点.此外,这一技术革新还引起了对人类创造性劳动和文化表达发展的深入思考,要求法律体系在保持对创作活动充分激励的同时,也要保护公众利益并促进文化多样性的发展.未来,版权法律和政策的灵活性将是应对技术进步速度的关键,旨在通过深入的理论研究和广泛的社会共识来实现有效的法律改革.
Abstract
With the breakthrough in artificial intelligence technology,notably the advancement of large-scale models such as Sora,the paradigm of cinematic creation is experiencing an unparalleled shift.This transformation not only significantly expands the horizons of creativity but also challenges the foundational concepts of traditional copyright law,including authorship,the originality of the works,and their ownership.The Sora model has facilitated a novel form of collaboration between humans and machines,diversifying artistic creation activities and concurrently provoking a reevaluation of legal issues surrounding copyright ownership,the term of protection,and the doctrine of fair use.In confronting these challenges,copyright law must evolve to align with new creative practices,striving to find a new equilibrium between safeguarding individual rights and fostering technological advancement.Additionally,this wave of technological innovation necessitates a profound contemplationon the evolution of human creative endeavors andcultural expressions,demanding a legal framework that not only incentivizes creative activities but also protects the public interest and encourages the growth of cultural diversity.Looking forward,the adaptability of copyright laws and policies will be crucial in keeping pace with technological advancements,aiming for effective legal reform through comprehensive theoretical studies and widespread social consensus.
