学术期刊数据库健康发展的法治支撑——版权保护、竞争问题与法治完善

摘要
解决我国学术期刊数据库的版权保护和垄断问题,须坚持有利于鼓励学术创新、有利于提升学术成果传播效率和有利于促进学术评价公正性的基本原则.对于期刊数据库的信息网络传播权问题,应区分历史阶段分类解决存量权利许可问题,规范增量版权许可行为,在尊重数字经济的特殊性的基础上确定合理的版权使用费标准.对于期刊数据库的垄断问题,要按照"基础服务公共化、衍生服务市场化"原则,不断推进学术期刊数据库公共基础设施建设,积极推动学术作品开放获取,从根本上和长远上解决公益性与营利性的矛盾和学术评价问题.
Abstract
Resolving the issues of copyright protection and monopolies in Chinese academic journal databases requires adherence to fundamental principles that help to encourage academic innovation,enhance the efficiency of academic knowledge dissemination,and promote fairness in academic evaluation.Regarding the issue of internet dissemination rights of journal databases,it is necessary to address the issue of existing licenses based on different historical stages,regulate incremental copyright licensing behaviors,and determine the reasonable royalty for copyright based on the characteristics of the digital economy.To address the monopoly problems,it is essential to follow the principle of"publicization of basic services and marketization of derivative services,"continuously promote the construction of public infrastructure for academic journal databases,actively encourage open access to academic works,which can fundamentally and long-termly resolve the contradiction between public interest and private interest as well as academic evaluation issues.
