摘要
数字融媒环境下,以"创造性转化和创新性发展"为导向进行红色文化资源的开发、利用和传播已然成为政策导向与文化发展趋势,相关版权问题逐渐凸显.于历史维度,通过司法个案的剖析,认为需聚焦于司法技术的完善进一步调和红色经典作品与版权制度的旧有矛盾;于现实层面,基于制度建构历史的考察,发现现有馆藏作品合理使用制度在立法理念上无力贴合当下红色文化遗产的数字化实践要求;于近景展望,立足我国博物馆事业国家主导特征的分析,得出版权政策指引不足诱发红色文化遗产数字资源的管理混乱趋向.基于上述问题分析,宜出台专门性司法解释进一步弥合红色经典作品的版权纠纷,适当调整我国版权法上合理使用制度因应红色文化遗产数字化实践,细化文博领域版权政策指引以规范革命博物馆的数字资源管理.
Abstract
Under the environment of digitization and convergence media communication,the development,utilization and dissemination of red cultural resources under the guidance of"Creative Transformation and Innovative Development"has become a policy-oriented and cultural development trend,and related copyright issues have gradually become prominent.In the historical dimension,through the analysis of judicial cases,it is necessary to focus on the perfection of judicial rule to further reconcile the old contradiction between red classic works and copyright system;In present perspective,based on the investigation of the history of system construction,it is found that the existing fair use system of collection works is unable to meet the current digital practice requirements of red cultural heritage in the legislative concept;Based on the analysis of the government-led characteristic of museums in our country,it is concluded that the lack of copyright policy guidance induces the chaotic management trend of the digital resources of red cultural heritage.Based on the analysis of the above problems,it is appropriate to issue a special judicial interpretation to further resolve copyright disputes of red classic works,appropriately adjust the fair use system in copyright law to cope with the digital practice of red cultural heritage,and refine the copyright policy guidelines in the field of cultural relics and museums to standardize the digital resource management of revolutionary museums.
