摘要
著作权法保护的是地图作品,而非一般意义上的地图,即其不保护图形符号的技术实用功能、商誉指代功能和广告表彰功能.分析电子地图出版物的可版权性、权利归属及侵权认定,有助于我们对著作权法中的可版权要件、独创性、改编演绎、职务创作、接触可能、实质性相似、主观过错及合法来源抗辩等诸多重要概念展开深入的研究与思考,进而为市场竞争与行业发展划定更为清晰的正当性边界.
Abstract
Copyright law protects map works,rather than general maps,which do not protect the technical and practical functions of graphic symbols,goodwill reference functions,and advertising recognition functions.Analyzing the copyrightability,ownership,and infringement determination of electronic map publications can help us conduct in-depth research and reflection on many important concepts in copyright law,such as copyrightable elements,originality,adaptation and deduction,job creation,possibility of contact,substantive similarity,subjective fault,and legitimate source defense,and thus delineate clearer legitimacy boundaries for market competition and industry development.
