摘要
2023年,上海知识产权法院共受理著作权纠纷案件1101件,其中,一审著作权纠纷案件411件(侵害计算机软件著作权纠纷410件,计算机软件著作权合同纠纷1件),二审著作权纠纷案件678件(著作权侵权纠纷578件,著作权合同及权属纠纷100件),其他案件12件.共审结著作权纠纷案件1072件,其中,一审著作权纠纷案件501件,二审著作权纠纷案件561件,其他案件10件.现选取其中具有典型意义的案例向读者介绍.
Abstract
In 2023,the Shanghai Intellectual Property Court dealt with a total of 1101 copyright dispute cases.Among these,there were 411 first-instance copyright dispute cases(410 cases of computer software copyright infringement disputes and 1 case of computer software copyright contract dispute),and 678 second-instance copyright dispute cases(578 cases of copyright infringement disputes and 100 cases of copyright contract and ownership disputes),along with 12 other cases.A total of 1072 copyright dispute cases were concluded,including 501 first-instance cases,561 second-instance cases,and 10 other cases.Some of the typical cases are selected to introduce to the readers.
