2023年北京互联网法院著作权典型案例及评析

摘要
2023年北京互联网法院共受理涉网著作权侵权纠纷案件9383件,共审结12785件.一年来,法院坚持以裁判树规则、以规则促治理,规范引导典型案例发现、培育、指导工作,打造一系列具有示范引领效应的典型案件,依法加强新类型客体保护、合理界定新型传播行为责任边界、积极引导互联网新技术应用、坚决遏制恶意诉讼行为,不断强化互联网司法裁判规则引领作用与价值导向功能.
Abstract
In 2023,Beijing Internet Court accepted 9383 cases of Internet copyright infringement disputes and concluded 12785 cases.Over the past year,Court adhered to the principles of establishing rules through adjudication and promoting governance through rules.It standardized and directed the discovery,cultivation,and directed of typical cases,refining a series of exemplary cases with a leading effect.The court strengthened the protection of new types of objects according to the law,reasonably defined the boundaries of liability for new types of dissemination behaviors,actively guided the application of new Internet technologies,and firmly curbed malicious litigation behaviors.These continuous efforts reinforced the rule-guiding role and value-orientation function of the Internet judicial adjudication.
