摘要
智能传播时代的到来使得视频新闻成为人们获取新闻信息的主要形式,不同于普通的、连续的活动性视频,视频新闻具有明显的新闻性质;与其他形式的新闻相比,视频新闻的版权保护面临着更多复杂的问题.沿着版权立法的思路展开探究,首先,结合视频新闻的具体分类和思想与表达二分法对其属于视听作品或录像制品予以界定;其次,根据不同的作品使用方式对视频新闻的侵权行为进行分类和认定;再次,从创作主体在数量上或者性质上的特征出发,依法讨论视频新闻的权属分配;最后,着眼于合理使用的适用,结合法律规定与司法原则,提出要平衡新闻制作者的著作权利与新闻传播的社会公共利益,构筑适用于视频新闻的开放式合理使用制度.
Abstract
The advent of the era of intelligent communication has made video news the main form for people to obtain news information.Unlike ordinary continuous activity videos,video news has distinct journalistic characteristics.Compared to other forms of news,the copyright protection of video news faces more complex issues.This study follows the line of copyright legislation and begins by defining video news as either an audiovisual work or a cinematographic work based on its specific classification and the idea-expression dichotomy.Secondly,it classifies and identifies copyright infringement of video news based on different uses of the works.Thirdly,it discusses the allocation of copyright ownership of video news based on the number or nature of the creators.Finally,it focuses on the application of fair use and,in combination with legal provisions and judicial principles,proposes a need to balance the copyright of news creators with the social public interest of news dissemination,in order to establish an open fair use system suitable for video news.
