2023年深圳知识产权法庭版权典型案例及评析

深圳经济特区位于粤港澳大湾区核心地带,科技创新活跃、文化市场繁荣.2023年,深圳知识产权法庭审理了大量涉版权侵权纠纷一、二审案件,版权侵权案件呈增长趋势,这其中包括一些典型、疑难复杂、前沿性的案件,通过高效、公正审结这些案件,为粤港澳大湾区市场经济的发展和文化事业的繁荣保驾护航.现选择其中具有代表性的案件向大家介绍,包括将他人美术作品作为手机外壳装饰图案、涉外体育赛事节目直播或点播、网络环境下美术作品抄袭、使用他人影视剧作品的截图进行商业化利用引发的版权侵权纠纷案.
Abstract
Shenzhen Special Economic Zone is located in the core area of the Guangdong-Hong Kong-Macao Greater Bay Area,with active scientific and technological innovation and a prosperous cultural market.In 2023,the Shenzhen Intellectual Property Court heard a large number of first-instance and second-instance cases involving copyright infringement disputes,and copyright infringement cases showed an increasing trend,including some typical,difficult,complex and cutting-edge copyright cases,which were concluded efficiently and fairly,escorting the development of the market economy and the prosperity of cultural undertakings in the Guangdong-Hong Kong-Macao Greater Bay Area.Some of the representative cases are now selected to introduce to you,including copyright infringement disputes arising from the use of other people's art works as mobile phone shell decoration patterns,live broadcast or on-demand broadcast of foreign-related sports events,plagiarism of art works in the network environment,and the use of screenshots of other people's film and television drama works for commercial use.
