空白区探矿权准入的法律规制

文章通过从法律层面解读探矿权的"申请在先"并将其与竞争性出让进行比较,探析"申请在先"具备的优势和可能的问题,以及"协议出让"在空白区的适用,提出空白区探矿权准入法律规制的建议:准入方式方面"申请在先"须限定于战略性紧缺矿产,空白区战略性非紧缺矿产适用"协议出让";准入程序方面引入听证和集体会审制度;准入主体资质方面纳入对探矿权申请人司法品行的要求.
Abstract
By interpreting the"application first"access method for exploration rights from the legal perspective and comparing it with the competitive transfer method,the paper analyzes the advantages and possible problems of the"application first"access method,as well as the applicability of the"agreement transfer"access method in the blank area.Further,the paper puts forward recommendations on the legal regulation of access to exploration rights in the blank areas:in terms of access method,"application first"access must be limited to strategic and critical minerals,and"agreement transfer"access should be applied to strategic non-shortage minerals in blank areas;in terms of access procedures,the system of hearings and collective hearings should be introduced;in terms of the qualifications of access subjects,the judicial conduct requirements to exploration right applicants shall be included.
