摘要

地质调查工作的高质量发展迫切需要法治保驾护航,然而,现有的立法供给不足,存在内容不完备且碎片化、层级较低、功能失衡等缺陷.文章以我国地质调查事业发展需求为着眼点,以切实解决地质调查工作法治保障不足问题为导向,遵循地质调查工作科学规律,借鉴域外地质调查立法路径选择经验,提出我国地质调查立法应当采取"嵌入式立法""专门立法"两种立法模式双线并行的立法路径,即利用各种立法契机有序开展嵌入式立法,同时积极筹备专门立法,待时机成熟,再制定"大地质"理念框架下的综合性立法,为营造美丽而安全的地质环境提供立法保障.

Abstract

The high-quality development of geological survey work urgently needs the protection of the rule of law.However,the existing legislation supply is insufficient,with defects such as incomplete and fragmented content,low level,and unbalanced function.Focusing on the development needs of China's geological survey as the focus and guided by the practical solution to the problem of the insufficient legal protection of geological survey work,the paper follows the scientific laws of geological survey work,and draws on the legislative path selecting geological survey experiences of the countries outside the territory,and proposes that China's geological survey legislation should adopt dual legislative models of"embedded legislation"and"special legislation".That is,by using various legislative opportunities to carry out embedded legislation in an orderly manner,and actively prepare special legislation simultaneously.A comprehensive legislation under the framework of the"Great Geology"concept will be formulated when the time is ripe,with the aim to provide legislative guarantee for creating a beautiful and safe geological environment.
