人工智能算法专利保护研究

伴随着诸多人工智能驱动的智能设备逐步渗透到社会的各个领域,其正在广泛而深刻地改变着工作和生活方式,其高价值性和技术创造性业已产生巨大知识产权保护需求.考虑到人工智能算法的抽象逻辑结构和思路,构建全面的算法专利保护体系仍是难度较大且亟待解决的问题.本文首先分析了世界各主要国家/地区对人工智能算法可专利性的标准原则,然后从证据距离、分离式侵权判定难度和跨境侵权判定难度三个维度分析了人工智能算法专利在侵权可视度方面存在的巨大挑战,最后提出了基于人工智能算法表现形式的专利布局、贯穿人工智能算法前中后端的专利布局和基于技术实现方案优化更新的专利布局三种人工智能算法专利布局策略.
Research on Patent Protection of Artificial Intelligence Algorithms
With the gradual penetration of various artificial intelligence(AI)driven intelligent devices into all areas of society,they are changing work and life in a wide and profound way,and their high value and technological creativity have generated huge intellectual property protection needs.Considering the abstract logical structure and the thought of AI algorithms,it is still difficult to build a comprehensive system for patent protection of algorithms.Firstly,this paper analyzes the standard principles of patentability for AI algorithms in major countries/regions around the world.Then,it analyzes the challenges of AI algorithm patent infringement visibility from three dimensions:evidence distance,difficulty of separable infringement judgment,and cross-border infringement judgment.Finally,this paper proposes three strategies for AI algorithm patent layout:layout based on AI algorithm expression forms,layout across the front-end,middle-end,and back-end of AI algorithms,and layout based on optimized updates of technical implementation plans.
