国际PCT质量体系发展问题与未来治理提升方向探讨

摘要
历经四十余年的发展,PCT已经发展成为相对成熟、全球运用最广泛的国际专利申请体系.然而,知识产权全球治理面临着"单边化"和"碎片化"的风险,中国作为PCT国际专利申请最大用户来源国,有责任有义务推动构建开放包容、平衡普惠的知识产权国际规则.本文通过研究PCT质量体系面临的问题与挑战,以及质量体系和主要议题的发展路径,分析PCT质量体系的改进路径思路,探讨未来治理提升的方向,可以为我国未来参与PCT全球治理提供借鉴参考.
Abstract
After more than 40 years of development,the PCT system has become a relatively mature and the most widely used international patent application system in the world.However,the global governance of intellectual property(IP)is facing the risks of"unilateralization"and"fragmentation".As the largest user country of the PCT,China has the responsibility and obligation to promote the construction of open,inclusive,balanced and universal international rules of IP.By studying the problems and challenges faced by the PCT quality system,as well as the development path of the quality system and the main issues,this paper helps to identify the improvement path and ideas of the PCT quality system and discuss the future quality improvement direction,and can provide reference for China's future participation in PCT global governance.
