Empirical Analysis on the Pilot Implementation of the China's LOR System from a Multi-Dimensional Perspective
The Licences of Right(LOR)system in our country has gone through a period of pilot exploration,and timely summarizing experiences and lessons can help the system to be steadily implemented.Empirical research on the pilot of LOR system from four dimensions(quantity distribution,quality level,licensing conditions,and transaction status)found that the pilot operation is generally good,with a total of 11733 LOR patents issued during the period.These patents mainly come from economically developed provinces,universities,and invention patents.And the quantity of the patents is greatly affected by policy changes.The overall quality level of patents is normal,and it is estimated that high-quality patents account for about 10%.The conditions for licenses are diversified,with 19.3%of patents limited their licensing scope to within the province,even cities and counties.The licensed period is mostly within 4 years.The payment method for license fees is mainly based on payment and supplemented by free payment.Up to now,1319 patents have been licensed for transactions and most of them come from universities.It is recommended to making the following optimizations in the future:Firstly,the LOR statement should not limit the licensed period.Secondly,introduce a flexible hybrid pricing model.Finally,guide and encourage the implementation of LOR patents that are needed by the market based on the fundamental nature,versatility,and mature nature of patents,as well as the intentions of both parties involved in the transaction.
