摘要
本文基于专利情报分析海关保护备案专利在我国的现状,为我国专利保护政策的制定及企业专利保护水平提升提供参考.通过检索有过海关备案记录的所有专利以及2015—2024年处于有效备案状态的专利,本文从专利类型、备案趋势、主要权利人及近10年活跃度、主要技术领域及近10年活跃度、权利人地域、专利质量、专利法律事件及专利运营趋势进行分析.研究表明,海关保护备案专利总量少、权利人及技术领域分散、权利人主要集中于经济发达地区、专利质量有待提高、专利海外布局占比低、备案专利市场关注度高.最后,根据研究结果提出提高专利保护水平的建议.
Abstract
Based on patent intelligence analysis of the current situation of customs protection filing patents in China,this paper provides references for the formulation of patent protection policies and the improvement of enterprise patent protection level in China. By searching all patents that have been registered with customs and patents that were effectively registered from 2015 to 2024,analysis is conducted on patent types,filing trends,main rights holders and their activity in the past 10 years,main technical fields and their activity in the past 10 years,rights holder regions,patent quality,patent legal events,and patent operation trends. Research shows that the total number of registered patents protected by customs is small,the rights holders and technical fields are scattered,the rights holders are mainly concentrated in economically developed areas,the quality of patents needs to be improved,the proportion of overseas patent layout is low,and the attention to the registered patent market is high. Finally,based on the research results,suggestions are proposed to improve the level of patent protection.
