摘要
科创板是支持科技创新型企业研发创新的重要融资平台.本文梳理了科创板上市审核中的知识产权相关要点,据此分析了知识产权纠纷发生的主要原因,通过统计分析自科创板开板以来申请注册上市企业的知识产权纠纷数据,归纳总结了近五年上述企业知识产权纠纷的变化趋势,以及常见的知识产权纠纷情形和分布特点,最后结合成功上市的企业案例,深入分析了常见的侵权纠纷、合作开发协议纠纷、专利权属纠纷等的应对策略,旨在为拟在科创板上市企业提供知识产权纠纷应对建议.
Abstract
The STAR Market is an important platform to provide financial support for enterprises of high-tech industries.This paper summarizes the key points related to intellectual property in the review of the STAR Market,analyzes the main reasons for intellectual property disputes,and summarizes the trend of intellectual property disputes in the past five years since the STAR Market started,as well as the common situations and distribution characteristics of intellectual property disputes.Finally,combined with successful registration cases,it deeply analyzes the response strategies for common infringement disputes,cooperative development agreement disputes,patent ownership disputes,etc.,aiming to provide suggestions for intellectual property dispute resolution for listed companies on the STAR Market.
