摘要
在全球经贸环境日趋复杂的背景下,研究美国 337调查对我国企业防范海外知识产权风险、应对海外知识产权纠纷具有重要意义.本文基于近年来美国337调查数据,选取不同维度具象分析了我国遭遇337调查的现状,特别是通信领域面临的行业困境,分析了我国企业目前在侵权风险防范意识、海外知识产权储备和337 调查应诉能力上的不足,并给出了应对337调查的策略建议,帮助中国企业选择合理措施应对纠纷,助力中国企业出海破局.
Abstract
Under the background of the increasingly complex global economic and trade environment,the study of U.S.Section 337 investigation is of great significance for Chinese enterprises to prevent overseas intellectual property risks and deal with overseas intellectual property disputes.Based on the data of U.S.Section 337 investigation in recent years,this paper analyzes the current situation of China-related Section 337 investigation in different dimensions,especially in the field of communications industry,and also analyzes the drawbacks of Chinese enterprises in the awareness of infringement risk prevention,overseas intellectual property reserves and the ability to cope with the Section 337 investigations.Corresponding strategies are put forward for dealing with the Section 337 investigation to help Chinese enterprises to take reasonable measures to respond to disputes,and to develop overseas market.
