The Practical Dilemma and Institutional Response to the Protection of the Interests of Service Inventors
This paper makes a general survey of the service invention system of our country,there are problems such as insufficient safeguard and relief measures for"quasi-service inventors"in the research and development stage,unclear standards and unclear scope for identifying service inventions,and deficiencies in the profit distribution system,resulting in difficulties in fully protecting the rights and interests of service inventors.Referring to extraterritorial experience and based on China's actual national conditions,the improvement of the ownership regulations and remuneration payment system are two important factors to protect the rights and interests of service inventors.The focus should be on improving the protection and relief measures for scientific researchers in the research and development stage,solving the problem of defining service inventions with institutional support and innovative models,and improving the mechanism for obtaining remuneration for inventors with the purpose of freedom of contract.Thus,it helps to stimulate the enthusiasm and participation of inventors,and give play to the role of the organization in resource gathering as well,so as to realize the two-way force of the two in patent research and development and patent achievement transformation.
