"按需维保"下电梯安全责任的困境及化解

摘要
现代社会电梯的使用成为生活常态,"按需维保"政策出台对使用单位和维保企业提出了新的要求.传统侵权法的二元归责原则无法解决"物联网+按需维保"下的电梯安全责任难题,易引发司法裁判分歧,甚至混乱.通过引入危险责任原则,电梯行业以《中华人民共和国民法典》第一千二百三十六条规定为指引,可建立高度危险责任一般条款与特别法规定相结合的侵权责任归责模式,化解新背景下的安全责任困境问题.
Abstract
The use of lifts in modern society has become a commonplace in modern society,and the policy of maintenance on demands puts forward new requirements for users and maintenance enterprises.The traditional dual imputation principle cannot correspond to this new situation,which leads to confusion and disagreement in judicial adjudication.The principle of risk liability takes distributive justice as its theoretical premise,and the lift industry can learn from the corresponding regulations and establish a tort liability imputation mode combining the general provisions of highly risk liability with the provisions of special law,so as to resolve the dilemma of safety liability under the new background.
