基于案例释法的特种设备事故的界定分析研究

摘要
针对特种设备事故发生后,各级市场监管部门进行事故报告、应急处置及事故调查处理时存在监管边界不清的问题,结合新施行的《特种设备事故报告和调查处理规定》,在实施规定后,从特种设备事故定义及排除条款入手,以特种设备事故案例方式厘清监管人员比较关注的事故定性和监管边界,可以有效帮助基层特种设备监管部门开展监察工作,并以更为合理、高效且科学的方式开展相关事件调查处理.
Abstract
In view of the problem of unclear regulatory boundaries when market supervision departments at all levels conduct accident reporting,emergency treatment and accident investigation and treatment after the occurrence of special equipment accidents,combined with the newly implemented Special Equipment Accident Reporting and Investigation Treatment Provisions,the accident quality and supervision boundary that regulators pay more attention to are clarified in the way of special equipment accident cases,starting with the definition and exclusion of special equipment accidents after the implementation of the provisions.It is hoped that it will be helpful for grassroots special equipment safety supervision and law enforcement agencies to conduct supervision work and related incident investigation and treatment work.
