摘要
知识产权作为国家发展战略性资源,意指它是一种对国家经济、政治文明、改革开放、社会文明、生态文明、民生福祉和治理效能等进步起到全局性作用的资源.知识产权功能决定了它能够成为国家发展战略性资源.有效市场、有为政府和有用社会建设是知识产权成为国家发展战略性资源的基本条件、根本保证和重要支撑.这一新概念的提出并证成对知识产权法学研究具有重要价值:有助于摆脱知识产权法学人之间关于知识产权本质属性之争论,在更加抽象和宏观的视角上来看待知识产权;有助于更加全面认识知识产权法的本质、调整对象等基本问题,推进中国特色自主知识产权法学研究.它对知识产权法治建设也提出新要求:需要从积极意义上来合理定位政府职能,增加知识产权领域行政法供给;需要制定更多表达国家和社会公共利益的知识产权法;需要制定公法意义上的知识产权基础性法律.
Abstract
Intellectual property is a strategic resource that plays an overall role in the progress for nation-al development.The construction of effective market,promising government and useful society is the basic condition,fundamental guarantee and important support for intellectual property to become a strategic re-source for national development.This new concept is proposed and proved to be of great value to the re-search of intellectual property law.It also puts forward new requirements for the construction of the rule of law of intellectual property.
