摘要

教育法法典化为教育申诉制度的完善提供了有利契机,是否应将教育申诉制度编纂入典以及如何妥当安置,应从理论层面加以厘清.教育申诉在立法价值和功能定位上均有其他机制不可替代的重要作用,有必要将其编入法典.在法律实践中,教育申诉制度规范未完全整合、制度定位没有厘清以及规范内容不完善的疏漏对教育申诉入典形成掣肘.要解决以上问题,理论上应采纳程序法的基本原理,使用提取公因式的立法技术,将教育申诉置于教育纠纷解决篇中,在明确教育申诉制度内容的基础上整合旧规范,补充设定新规则.

Abstract

The codification of education law provides a favourable opportunity for the improvement of the educational appeal system,and it should be clarified at the theoretical level as to whether the educational appeal system should be codified and how it should be properly placed.It should be noted that educational appeal has an important role in terms of legislative value and functional position that cannot be replaced by other mechanisms,and it is necessary to codify them.In legal practice,educational appeal system norms are not fully integrated,the system positioning is not clear and the norms of the content of the imperfect omissions of the educational appeal into the code to form a constraint.To solve these problems,the theory should adopt the basic principles of procedural law,use the legislative technique of axiomatic extraction,place educational appeal in the chapter of educational dispute resolution,integrate the old norms on the basis of clarifying the content of the educational appeal system,and supplement the setting of new rules.
