桥区水域船舶水上交通安全管理法规研究

随着海洋经济的快速发展,跨海桥梁建设加速推进,大桥水上交通安全管理与船舶通航、港口岸线利用等之间的矛盾日益突出.有必要结合海事管理实践,对《海上交通安全法》《桥区水域水上交通安全管理办法》等法律法规中涉及桥区水域水上交通安全管理的条款、桥区水域水上交通安全管理实践中遇到的问题进行系统梳理,进一步明确超桥梁通航尺度、禁止进入桥区水域、桥区水域禁止性行为等条款的适用,确保海事管理机构依法履职.
Abstract
With the rapid development of marine economy,the construction of cross-sea bridges has been accelerated,and the conflict between the maritime traffic safety management concerning such bridges,the navigation of ships and the utilization of port shoreline has become increasingly prominent.It is necessary to make a systematic review on the provisions concerning water traffic safety management in bridge waters in relevant laws and regulations including the Maritime Traffic Safety Law and Administrative Measures on the Water Traffic Safety Management for Bridge Waters and the problems encountered in the practice of water traffic safety management in bridge waters in view of maritime management practices.Furthermore,the application of provisions on exceeding bridge navigable scale,prohibition of entry into bridge waters,and acts prohibited in bridge waters should be clarified,so as to ensure that the maritime administration performs its duties according to law.
