The newly revised Maritime Traffic Safety Law of the People's Republic of China clearly stipulates that the maritime administrative agency shall be responsible for the investigation and determination of the liability for maritime traffic accidents that occur in the sea areas under its jurisdiction,and the certificate of liability determination issued by the maritime administrative agency shall be used as evidence for handling maritime traffic accidents.This article starts with the definition and characteristics of the administrative act,and analyzes whether the determination of maritime traffic accident liability by maritime management agencies belongs to administrative act.Furthermore,it puts forward suggestions for maritime administrative agencies to further improve the identification of liability for maritime traffic accidents.
