摘要

海运货物控制权是平衡海洋运输国际货物贸易当事人之间权益的制度设计,数字化海运货物控制权进一步推动国际货物贸易模式复杂化.我国应积极应对由此产生的国际贸易新变化,参与或主导相关国际规则的制定,并及时优化国内立法释放制度优势,为参与国际法治实践积累经验.

Abstract

Right of control over the goods of maritime transportation is an institutional design that balances the rights and interests of trade parties involved in the international transportation of goods by sea.The digital"right of control"over the goods of maritime transportation further upgrades the complexity of international cargo trade modes.China should actively respond to the new changes in international trade,take an active part in or lead the formulation of relevant international rules,and duly optimize domestic legislation to give play to institutional advantages,thus accumulating experience for participating in international rule of law practice.
