摘要
为更好地保障智能船舶发展,围绕智能船舶对船舶保险条款的适用性展开研究.通过对智能船舶和船舶保险条款现状、智能船舶适用船舶保险条款所遇困境、保险行业承保智能船舶的顾虑三方面进行详细分析,发现智能船舶存在法律地位不明确、责任主体认定复杂、可供参考数据少、风险评估难度大等问题,提出智能船舶在法规修订、加强保险行业和企业合作等方面的建议,以期为智能船舶在风险控制、管理方面提供参考,推动智能船舶快速发展.
Abstract
In order to better support the development of intelligent ships,this paper focuses on the applicability of ship insurance clauses to intelligent ships.Through a detailed analysis of the current status of intelligent ships and ship insurance clauses,the challenges encountered in applying ship insurance clauses to intelligent ships,and the concerns of the insurance industry in underwriting intelligent ships,such issues are identified including the unclear legal status of intelligent ships,complex identification of responsible entities,limited availability of reference data,and difficulty in risk assessment.Based on the above,suggestions are proposed for intelligent ships in terms of amending laws and regulations and strengthening cooperation between the insurance industry and enterprises,aiming to provide guidance for intelligent ships in risk control and management and promote the rapid development of intelligent ships.
