Hot Issues and Suggestions of the Wild Animal Protection Law Revise
At present, China is revising “Wild Animal Protection Law”, and some of the hot issues provoke discussions. For the authors there are a few recommendations to state in the following. Firstly, in terms of legislative purpose, it may provide habitat protection, regulate the use of wildlife resources and the conservation of biodiversity. Secondly, in terms of protecting object, the law should combine key protection and general protection to change the three classifi cation standards-“Benefi cial or of important economic or scientifi c value”, as well as expand the scope of protection habitats. Thirdly, as for domestication and breeding, unequivocal “scientifi c domestication and breeding” approach and animal welfare need to be specified. Under the above principles, it is crucial to formulate directory to regulate artificial breeding and utilization, implement scientific reintroduction. Fourthly, in terms of social governance, it’s necessary to clear information disclosure and public participation principles, to broaden the channels for public participation by funding and giving social organizations the rights of public interest litigation, meanwhile, industry associations need to be self-discipline. Fifthly, as for liability, it is of great signifi cance to further clarify the responsibility of consumers and regulators, increase the types of offenses and penalties, stress network market regulation, and establish wildlife virulence compensation fund.
