摘要
人工智能创作行为可以概括为"数据输入—机器学习—结果输出"3个阶段,数据输入涉及人工智能创作行为中数据获取和使用的合法性问题.传统的"作者中心主义"和"三步检验法"逐渐不能适应促进创新和人工智能技术发展的时代需要,应对合理使用制度进行相应优化.另外,我国著作权法的发展也应走出"立法技术的壁垒",积极为新兴事物的发展开辟合法化的适用空间,采取弹性、开放的立法模式.
Abstract
Artificial intelligence creation behavior can be summarized into three stages:"data input-machine learning-result output".Data inputting involves the legality of data acquisition and use in artificial intelligence creation behavior.The traditional"author-centrism"and"three-step test method"gradually can not meet the needs of The Times to promote innovation and the development of artificial intelligence technology,so the rational use system should be optimized accordingly.In addition,the deelopment of Chinese copyright law should also go out of the"legislative technology barrier",actively open up legal application sapce for the development of emerging thingsand adopt the elastic and open legislative mode.
