摘要
人工智能在刑事侦查领域的应用日益广泛,在提高侦查效率和准确性的同时,带来了合法性方面的挑战.本文通过分析现有文献,探讨人工智能在侦查中的合法性风险,包括主体合法风险、数据收集与使用的合法性分析、现行法律规制的适应性问题以及人工智能侦查决策过程合法风险,以期为人工智能在侦查工作中的应用提供参考.
Abstract
The application of artificial intelligence in the field of criminal investigation is becoming increasingly widespread.While it enhances the efficiency and accuracy of investigations,it also poses challenges regarding legality.This paper explores the legal risks associated with the use of artificial intelligence in criminal investigation by analyzing existing literature.The discussion covers the legitimacy risks of the entity,the legality of data collection and use,the adaptability of current legal regulations,and the legal risks in the decision-making process of artificial intelligence-assisted investigations,in order to provide reference for the application of artificial intelligence in investigation.
