集体建设用地入市"双轨制"转型构造与耦合机制

本文运用"双轨制"转型这一分析框架考察农村集体建设用地市场化配置改革.研究发现,基于内外有别的集体建设用地配置逻辑,集体建设用地入市应当采取"双轨制"转型策略,在不触动原有的集体建设用地供地许可制度的前提下,从允许经营性用途的集体建设用地入市开始,让市场化配置和行政方式配置并行,先由行政方式在集体建设用地配置中发挥主导作用,再逐步由市场化配置取得主导地位.原有的集体建设用地供地许可制度是面向农村集体经济组织或其成员使用本集体建设用地的特惠性制度安排,属于行政方式配置土地的范畴,而新引进的集体经营性建设用地入市制度则是面向各类市场主体使用集体建设用地的普惠性制度安排,代表了集体建设用地入市"双轨制"转型的方向.集体建设用地供地许可和集体经营性建设用地入市在静态结构上交织嵌套、在功能适用上重叠竞争、在动态演进中双向耦合,推动着"双轨制"转型过程中二者此消彼长和主辅易位.集体经营性建设用地入市改革要防止"假入市,真许可",遵循"缩面、限权、公开和赋能"四个原则,与集体建设用地供地许可制度改革联动,分阶段有步骤地推进集体建设用地入市"双轨制"转型.
The Transformation Structure and Coupling Mechanism for the"Dual-Track System"of Collective Construction Land Marketization
This paper employs the"dual-track system"transformation as an analytical framework to examine the reform of market-oriented allocation of rural collective construction land.The study finds that based on the allocation logic of collective construction land distinguishing between collective members and non-members,the reform of collective construction land marketization should adopt.a"dual-track system"transformation strategy.Specifically,without disturbing the original system of land supply permits for collective construction land,it starts with allowing collective construction land for commercial use to enter the market,and allowing market-oriented allocation and administrative allocation to run concurrently,where the administrative allocation plays a dominant role in the allocation of collective construction land at first,and then the market-oriented allocation gradually gains a dominant position.As an administrative approach of land allocation,the existing collective construction land supply license is a preferential institutional arrangement for rural economic collectives or their members using collective construction land.The newly-introduced institutional arrangement on collective construction land marketization is inclusive for all kinds of market entities,and represents the direction of the"dual-track system"transformation of collective construction land marketization.The land supply permits for collective construction land and the collective construction land marketization are interwoven and nested in static structure,overlap and compete in functional application,and are coupled in a two-way dynamic evolution,promoting the waxing and waning of the two and the change of primary and secondary roles during the"dual-track system"transformation process.The reform of collective construction land marketization should be prevented from moving towards"fake market entry,real permission",the reform of the collective construction land supply license should be coordinately promoted in accordance with the four principles of narrowing the application,limiting the power of license,enhancing openness,and expanding the capacity of collective land usufruct,and the"dual-track system"transformation of collective construction land marketization should be promoted in a phased and step-by-step manner.
