我国高等学校教师课程权利范畴、边界与禁区

我国高校教师的课程权利既有实体法的法源基础,也有各个高校制定的相关的章程及管理制度的软法依据.其课程权利范畴包括:教材选用权、教法选择权、教学材料选择权以及课程评价权.但是高校教师的课程权利存在若干边界和禁区.在边界方面,不得跨越言论自由的边界、不得跨越公共利益、教学方法符合学校要求等;在禁区方面,高校教师的课程权利不能违背政治方向、不得选择不雅内容、不得拒绝学校的合理要求或规定、不得讨论与课程无关的内容、不得挖苦讽刺甚至骚扰学生、不得宣传或实施宗教活动.
Scope,Boundary,and Restricted Area of Teachers'Curriculum Rights in Chinese Universities
University teachers'curriculum rights in China can not only base on the foundation of the substantive law,but also the soft law of the related charter and management system formulated by universities.The scope of course rights in-cludes the right to choose teaching materials,the right to choose teaching methods,the right to choose teaching materials,and the right to evaluate the course.Howev-er,the curriculum rights of college teachers have some boundaries and forbiddenareas.In terms of boundaries,they should not cross the boundaries of freedom of speech,public interests,and teaching methods in line with school requirements.In terms of forbidden areas,college teachers'curriculum rights should not go against political direction,choose indecent content,refuse reasonable requirements or reg-ulations of the school,discuss content unrelated to the curriculum,satirize or even harass students,or publicize or implement religious activities.
