民国时期学校立法的历史演进与逻辑嬗变

学校立法既是民国教育的重要组成部分,也是中国学校教育制度建设的宝贵遗产.通过学校立法,初步构建起我国近代学校制度体系,对晚清民初转型时期学校教育的秩序稳定与可持续发展发挥了护航与定向的作用.民国时期教育界、立法界对于学校法律地位与责任、立法权限多级化、立法主体多元化、学校立法的国际视野等问题都进行了深入的实践探索.在学校法律制度现代化的时代背景下,中国的学校立法呈现出由封闭走向开放,由传统走向现代的基本趋势.民国时期学校立法的实施,推动了中国传统旧学制的现代化转型,为我国学校教育的发展提供了法制保障.学校教育制度的创新性变革也为我国教育的法制建设奠定坚实的历史基础,促进了中国现代学校制度的形成与发展.
The Historical Evolution and Logical Transformation of School Legislationin the Republic of China
School legislation is not only an important part of the education in the Republic of China,but also a precious heritage of the construction of the school education system in China.The modern school system of our country was initially constructed through the school legislation,and played a role of escort and orientation in the stability and sustainable development of school education during the transition period of the late Qing Dynasty and the early Republic of China.During the Republican era in China,the educational and legislative spheres have conducted comprehensive practical explorations regarding the legal status and re-sponsibilities of schools,the multi-tiered legislative authority,the diversification of legislative subjects,as well as an international perspective on school legislation.Under the background of the modernization of school law system,China's school legislation shows a basic trend from closed to open,from traditional to modern.The implementation of school legislation in the Republic of China promoted the modernization of traditional Chinese school system and provided legal guarantee for the development of our country's school education.The innovative reform of the school education system has also laid a solid historical foundation for the legal construction of education in our country and promoted the formation and develop-ment of China's modern school system.
