论科技共识和宪法共识
On Scientific and Technological Consensus and Constitutional Consensus

摘要
科技共识与宪法共识是政治共同体两种基本的共识形态,科技共识属于认知性共识,宪法共识属于规范性共识.处理好这两者的关系,对于维系共同体秩序具有重要意义.科技共识与宪法共识在价值上具有一致性.从历史的角度看,科技共识已经融入了宪法共识,两者互相影响,同步发展.在实践中,既需要利用科技共识促进宪法共识的形成,推动宪法实施,也应当将科技共识纳入宪法共识,在宪法共识下有效地发挥科技共识的功能.我们需要运用科技推动人类社会发展,但面对科技发展过程中存在的不确定性,应更加重视宪法共识的整合功能,在依宪治国的理念下合理规范并有效发挥科技共识的功能.
Abstract
Scientific and technological consensus and constitutional consensus are two basic forms of consensus in a political community.There are differences and connections between the two.First,they are different in nature and function.The scientific and technological consensus is cognitive con-sensus,while the constitutional consensus is normative consensus.Second,the two kinds of consen-suses influence and promote each other.The scientific and technological consensus has been inte-grated into the constitutional consensus,and embodies values that are consistent with the lat-ter.The two consensuses develop simultaneously and interact on each other.We need to make full use of the scientific and technological consensus to promote the formation of constitutional consen-sus,which will contribute to the implementation of the constitution.At the same time,the scientif-ic and technological consensus should be incorporated into and regulated by constitutional consen-sus.Facing the uncertainties caused by technology,we should pay more attention to the integration function of the constitutional consensus,safeguard the authority of the constitution,and ensure the well functioning of the two consensuses.
