网络主权:互联网时代对主权观念的重塑

摘要
互联网大大增加了人类活动的密切程度,从而使主权观念得以依赖的空间与边界的确定性和绝对性在物理与观念领域都发生了深刻变化.在以开放共享为重要特征、既无绝对领土又无唯一最高权威的网络空间中,网络主权的治理主体、治理内容、治理理念、治理规则以及主权的维护手段方面都发生了显著的变化,而维护网络主权也面临许多新问题与新挑战.在这种背景下,发展中国家必须采取有针对性的措施来维护网络主权,应当提升对网络主权的共识从而增强网络国际合作治理的思想基础,积极参与网络空间国际规则的制定以提升在网络国际合作治理中的话语权,并通过增强网络安全能力以更好地维护国家主权与安全,促进网络技术创新,从而有效提升维护网络主权能力的自主性.
Abstract
The Internet has greatly increased the closeness of human activities,and has made the kind of certainty and absoluteness of space and boundaries on which the concept of sovereignty relies undergo profound changes in both physical and conceptual worlds.In a cyberspace characterized by openness and sharing without absolute territory or supreme authority,significant changes have oc-curred in the subjects,content,concepts,and rules of governance,as well as the maintenance methods of cyberspace sovereignty.There are many new issues and challenges to safeguard cyber-space sovereignty.Against this background,developing countries must take measures to safeguard the network sovereignty,should enhance consensus on the network sovereignty so as to strengthen the ideological basis of international cooperative governance on internet,actively participate in the formulation of international rules in cyberspace to raise their voice in international cooperative gov-ernance on internet,better safeguard national sovereignty and security by enhancing cyberspace se-curity capabilities,promote innovation for network technology,and effectively enhance the autono-my of maintaining sovereignty in cyberspace.
