稳定土地承包关系与"二轮延包"时的承包地调整

摘要
稳定土地承包关系一直是我国农村土地政策的基本目标,是巩固和完善农业经营体制的基础,传达着对承包地保障功能的关注,也关涉"放活土地经营权"政策的落实.在法律上,稳定土地承包关系既体现为土地承包经营权的物权定性与保护,也表现为承包期限届满后的自动延包,承包地的调整也就限定于极为特殊的情形.仅在"因自然灾害严重毁损承包地"以及与之程度相当的情形之下,才允许在严格遵循法律规定的程序之下调整个别农户之间的承包地,因承包方家庭人口增减所导致的人地矛盾突出,不能通过调整承包地解决.有条件的地方可以将未发包的农用地再次分配,无地少地的农户可以通过流转土地经营权或者受让土地承包经营权以耕种土地,还可以通过发展第二、三产业等途径解决就业问题.
Abstract
Stabilizing the relationship of land contract has always been the basic objective of China's rural land policy and the basis for consolidating and improving the system of agricultural manage-ment.It is also related to the security function of the contracted land and the implementation of the policy of"revitalizing the right to operate land".Legally,the stabilization of land-contracting rela-tions is reflected both in the characterizing and protecting the property right of land-contracted man-agement rights and in the automatic extension of the contract after its expiration.The adjustment of contracted land is limited to very special circumstances.Only when the contracted land is seriously damaged due to natural disasters or similar situations,it is allowed to adjust the contracted land a-mong individual farmers under the procedures strictly prescribed by the law.The prominent contra-diction caused by the increase or decrease of the contractor's family members cannot be solved by adjusting the contracted land.Agricultural land that has not been contracted can be redistributed a-gain where conditions permit,and farmers with little land can cultivate the land by transferring the rights of land management or the rights of contracted land management,while the employment problems can be solved by developing the secondary and tertiary industries.
