集体经营性建设用地使用权独立征收补偿的确立与实现——基于权利逻辑的证成

摘要
集体经营性建设用地使用权的独立征收补偿地位尚未确证,法定集体土地征收补偿项目涵摄不足,征收补偿标准也有欠合理.规则的缺位根源于对权利逻辑的背离,现行集体土地征收补偿制度在征收客体上奉行物的逻辑,在补偿对象上奉行身份逻辑,对权利的保障有欠周全.以权利逻辑统合征收与补偿,征收补偿制度应从以土地为征收客体、以身份为补偿指向,转型为以权利为征收客体和补偿指向.依循权利变动的逻辑,具有对抗效力的各项权利均可成为独立征收客体.为达致权利功能的替代之补偿效果,应对市场化权利与社会保障性权利确立不同补偿标准.集体经营性建设用地使用权作为市场化的用益物权,具备独立征收补偿地位.综合考虑必要性与可行性,实现集体经营性建设用地使用权独立征收补偿,应重塑安置补助费以担纲对应的补偿项目,并以市场价格确立补偿标准.
Abstract
The status of independent expropriation and compensation in regard to the right of using the land for collective commercial construction has not yet been confirmed,the item of statutory compensation is not sufficiently inclusive,and the standards of compensation are not reasonable.The lack of rules is rooted in the deviation from the logic of rights,and the current system of collec-tive land expropriation compensation follows the logic of objects in expropriation and the logic of i-dentity in compensation,a practice incomplete for the protection of rights.In order to unify expro-priation and compensation with the logic of rights,the system should be transformed from taking land as the object of expropriation and identity as the point of compensation to taking rights as the object of expropriation and the point of compensation.Following the logic of the change of rights,rights with effectiveness against the third parties should all become independent expropriation ob-jects.To achieve the compensation effect of substituting the function of rights,different standards of compensation should be established for market-oriented rights and the rights of social security.As a market-oriented usufruct right,the right of using the land for collective commercial construc-tion has the status of independent expropriation compensation.Considering the necessity and feasi-bility of realizing independent expropriation compensation,the subsidy for resettlement should be reshaped to form the item of corresponding compensation,and the standard of compensation should be set with the market price.
