On the Constitutional Basis of the Report on the Work of the Chinese Government
Unlike traditional government documents,the government's work report carries the au-thority in shaping its image,spreading governing concepts,implementing constitutional values,gaining broad support,carrying out national will,and accepting external supervision.According to the provisions of the Chinese Constitution,the government's work report is not only a political doc-ument,but also a constitutional arrangement,containing the constitutional requirements that the government's actions should comply with the constitutional norms,conform to the constitutional principles,safeguard the constitutional rights,and accept the constitutional supervision.As a fun-damental law of a country,the Constitution is the general charter to govern and safeguard the coun-try as well as the basis for administrative organs to be responsible for and to report their work.From a constitutional perspective,the system of the government's work report has at least four foundations,that is,the normative foundation possessed by the development of the constitu-tional system,the objective foundation set by the preamble provisions of the constitution,the guar-anteed foundation implied by the basic rights provisions,and the supervisory foundation granted by the institutional provisions of the state.In the process of developing people's democracy in the whole process and building Chinese path to its modernization,it is necessary to fully explain the constitu-tional basis contained in the government's work report system and to make it an open blueprint for administrative offering,a supervisory window for democratic systems,and a path to govern the country according to its constitution.
