On Basic Approaches to the Study of CPC Disciplines:Taking the Newly Revised"CPC Regulations on Disciplinary Sanctions"as an Example
The institutional design and practical exploration of the separation and connection of dis-cipline and law have resulted in the emergence and development of discipline of the Communist Par-ty of China.Current study in this field is characterized by the lack of systematic and standardized thinking.This makes it necessary to develop a systematic methodology to study the Party disci-pline.It means that,in order to develop such methodology,we need to take Marxist theory,legal theories,and the studies of Party history and Party building as fundamental guidelines.The imple-mentation of such systematic methodology means to study substantive and procedural aspects,to study punishment and its execution,and to study discipline and law enforcement in the regulatory system of disciplinary inspection,the Party regulatory system,and the system of socialist rule of law with Chinese characteristics.In order to develop a standardized methodology,we need first to respect the original intention of the regulations without arbitrarily applying them by analogy.We al-so need to use explanatory methods properly to avoid mechanical understanding of the regulations.Finally,we need to make good use of the four forms of supervision and discipline without interpre-ting them arbitrarily and strictly.
