摘要
我国网络文学市场拥有世界瞩目的规模体量和颇具特色的产业结构,但多年来也一直面临版权治理上的困境.本质上看,我国网络文学产业版权生态结构属于"生产秩序依赖型"而非"责任秩序依赖型",仅靠立法上的规范加码和司法上的索赔威慑并不能解决我国网络文学产业的版权治理难题,反易陷入治标不治本的窘境.应秉持"版权生态观",由传统的"版权分段保护"走向"版权综合治理",按照内容生产、流通和消费的逻辑进路,从底层逻辑入手,抓住网络文学产业版权治理的重点,通过强化版权制度规范供给,寻求内容治理与版权治理联动互促,重视许可秩序和利益分配的调整,建立标准化作品数据管理流通体系等方式,实现我国网络文学版权生态的良性循环.
Abstract
China's online literature market has a world-renowned scale and a distinctive structure,but it has been facing difficulties in copyright monetizing and protection.At present,the copyright governance of China's online literature market still maintains as the"content production dependence model"rather than the"legal responsibility dependence model",which means the revisions of law or the deterrence of litigations are not a key solution to the copyright problems it has been facing for years.The feasible solution is to strengthen the supply of copyright toolbox,promote the interactions between content creation and copyright protection,improve the framework of copyright licensing and the fairness of royalty distribution,and establish a reliable and standardized copyright data management system.
