我国与美国新冠疫情吹哨人制度的比较与完善

摘要
吹哨人制度自此次新冠疫情以来才逐渐得到大众关注,正式成为公共卫生法研究的对象,之前多用于公共利益受损的领域.首先对吹哨人制度的优势和弊端进行分析,然后以美国新冠疫情中吹哨人制度为基础,探讨了该国吹哨人制度在新冠疫情的发展中存在的问题和可资借鉴之处.进而在对美国处理新冠肺炎疫情制度进行比较分析的基础上,不断确立我国吹哨人制度的主要目标、明确该制度的法律特征、完善制度的可奖励性和司法救济渠道.
Abstract
The whistleblower system has gradually gained public attention since the COVID-19 epidemic,and has officially become the object of public health law research.Previously,it was mostly used in areas where public interests were damaged.This paper first analyzed the advantages and disadvantages of the whistler system,and then,based on the whistler system in the COVID-19 in the United States,discussed the problems and references of the whistler system in the development of the COVID-19 in China.Then,on the basis of comparative analysis of the system of dealing with the COVID-19 in the United States,we will continue to establish the main objectives of our whistleblower system,clarify the legal characteristics of the system,improve the systems incentive and judicial re-lief channels.
