摘要
在新冠疫情防控背景下,"健康码"的诞生正是数字时代的产物,为政府提高政务诚信建设提供了有力的支撑点.健康码运行机理分为申请、生成、应用三个阶段.在法律属性上,健康码的申请是一种行政许可,健康码的生成是一种行政裁量,健康码的应用是一种行政强制,但从健康码运行的全流程来看,它是一种自动化行政辅助决策行为.公民对健康码申请、生成、应用的异议均具有行政可诉性,为公众后续合法权益受损提供更广阔的救济途径.
Abstract
In the context of COVID-19 prevention and control,the birth of"health code"is the product of the digital age,which provides a strong support for the government to improve the construction of government integri-ty.The operation mechanism of health code is divided into three stages:application,generation and application.In terms of legal attributes,the applying for health code is an administrative license,the generation of health code is an administrative discretion,and the application of health code is an administrative compulsion.However,from the perspec-tive of the whole process of health code operation,it is an automatic administration-assisted decision-making behavior.Citi-zens objections to the applying,generation and application of the health code are all administratively actionable,providing a broader remedy for the subsequent damage to the legitimate rights and interests of the public.
