摘要
现行《传染病防治法》规定由各级人民政府发出传染病预警,但此次新冠肺炎疫情暴露了行政预警的迟延性.《传染病防治法》《医师法》《生物安全法》都规定了疾控机构传染病信息监测权,而信息监测是发布预警的必要前提.赋予疾控机构独立的科研预警权,提高预警的及时有效性,是我国卫生法律体系的发展趋势.
Abstract
The Law on Prevention and Control of Infectious Diseases stipulates that people's governments at all levels should issue early warning of infectious diseases,but this COVID-19 epidemic has exposed the delay of admin-istrative early warning.The Law on Prevention and Control of Infectious Diseases,the Law on Physicians and the Law on Biosafety all stipulate the right of information monitoring of infectious diseases of disease prevention and control institutions.Information monitoring is a necessary prerequisite for issuing early warning.It is the develop-ment trend of China's health legal system to endow disease control institutions with independent scientific research early warning rights and improve the timely effectiveness of early warning.
