药品网络交易第三方平台资质审核义务研究

摘要
《药品网络销售监督管理办法》进一步强调落实药品网络交易第三方平台主体责任,对平台资质审核义务设定明确核验周期,但目前法律尚未明晰平台资质审核义务的性质.在司法实践中,法官一般将其认定为形式审核义务.从药品安全的特殊性和义务设立的目的分析,该义务应被界定为实质审核义务.介绍药品网络交易第三方平台资质审核义务的立法现状,讨论第三方平台资质审核义务履行困境及义务落实途径.
Abstract
The Measure for the Supervision and Administration of Online Drug Sales further emphasizes the im-plementation of the primary responsibility of the third-party online drug trading platform and set a clear verification cycle for the platform's obligation of qualification examination.However,the nature of the platform qualification audit obligation has yet to be clarified by the law.In judicial practice,it is regarded as a formal examination by jud-ges.The obligation should be the substantive examination,based on the uniqueness of drug safety and the purpose of the obligation establishment.This paper introduced the legislative status of qualification obligations of the third-party online drug trading platform,discussed the difficulties of qualification obligations the third-party platform,and the ways to implement the obligations.
