医护人员的避险行为研究

摘要
针对目前暴力伤医事件仍时有发生的情况,梳理了各部门法对医护保护的范围和力度,选择了对医护权利影响最大的职业避险行为进行研究.从正当防卫、紧急避险到职业、行业规范全面分析医护人员的自主避险空间,据此援引"职业避险"这一独立于"紧急避险"的概念.期望由这一法律概念生成的法律效力,能帮助建立一套更加健全的医护行业应急反应机制,充分保障医护人员预防危险的权利,使医护保护空间不再仅限于事后补救和舆论反响.
Abstract
In view of the situation that violent medical injuries still occur,this paper sorted out the scope and intensity of medical protection by various departments,and selected the occupational hedge behavior with the grea-test impact on the rights of medical care.From justifiable defense and emergency hedge to occupational and industry norms,the independent avoidance space of medical staff is comprehensively analyzed,based on the concept that"oc-cupational hedge"is independent of"emergency hedge".It is expected that the legal effect generated by this legal concept can help establish a set of more sound emergency response mechanism for the medical industry,fully protect the right of medical staff to prevent danger,so that the space for medical protection is no longer limited to post-re-mediation and public opinion response.
