摘要
作为2021年新《行政处罚法》新增的一般行政处罚种类,通报批评在后疫情时代法治社会建设的现实需要下,受到疫情防控执法的广泛青睐.但通过实证分析疫情防控下1 004例通报批评发现,通报批评之实务适用存在极为严重的泛化问题,使其一般化适用陷入风雨飘摇之中.溯其根因,通报批评不恰当的适用造成了对处罚法定原则的严重破坏,从而无法挣脱上述问题的桎梏.为实现通报批评的正确适用,需对其进行规范解释,匡正其司法适用.
Abstract
As a new type of general administrative punishment in the new Administrative Punishment Law of 2021,the bulletin criticism is widely favored by the epidemic prevention and control law enforcement under the practical needs of the post epidemic era of the rule of law.However,through empirical analysis of 1 004 cases of bulletin criticism under the epidemic prevention and control,it is found that there are extremely serious problems in the practical application of the bul-letin criticism,which makes its general application in the wind and rain.Tracing to its root cause,the inappropriate applica-tion of notification of criticism has caused serious damage to the principle of legality of punishment,thus unable to break a-way from the shackles of the above problems.In order to realize the correct application of criticism in circulars,it is neces-sary to standardize its interpretation and correct its judicial application.
