With the development of artificial reproductive technology,surrogacy behavior has arisen,and at the same time brought a series of new social and legal problems,among which the issue of the ownership of surrogate child custody is particularly prominent.Although China's law stipulates the ordinary guardianship recognition sys-tem,there are no specific and clear provisions on the ownership of the custody of surrogate children.With the emer-gence of relevant precedents injudicial practice,the legal status of surrogate children and their parent-child relation-ship need to be further clarified,and through the empirical analysis of the current judicial practice and the attribution of surrogate children in reality,it is a feasible path to try to solve the problem of the attribution of surrogate children by combining the principle of best interests protection of children with other factors.It is recommended that the rel-evant legal system should be improved,the principle of surrogacy child custody should be established,surrogacy su-pervision should be continuously improved,and the judicial adjudication of similar cases should be promoted to uni-fied,so as to realize the protection of the legitimate rights and interests of surrogate children.
